AMENDMENTS TO ZONING ORDINANCE REGARDING POULTRY STRUCTURES AND REVERSE SETBACKS IN EFFECT AS OF JULY 3, 2006
Amend Section 5.6A Agricultural Uses
Delete from item 4: "Poultry and manure sheds." The Zoning Districts requiring Special Exceptions remain as in item 4.
Add the following text as item 5:
*Commercial Raising of Poultry and composters, manure sheds shall require a ten acre minimum lot area in all zones and the following setbacks:
*In all zones, a fifty (50) foot setback from side lot lines is required.
*In all zones, a seventy-five (75) foot rear setback from the property line is required.
*In all zones, a two hundred (200) foot front setback is required.
*In R-1, a minimum three hundred (300) foot setback is required from any dwelling or structure on another parcel.
*In all other zones, a minimum two hundred (200) foot setback is required from any dwelling or structure on another parcel.
Renumber items 5-8 to 6-9.
Amend Section 5.6 Dimensional Requirements in each District, other than Attached Housing, notes following "a".
Revise note *****:
*****If a new residential lot is submitted for subdivision approval after the effective date of this Ordinance, and the lot will be contiguous to an existing poultry or livestock principal use, any future home built on the lot shall be setback a minimum of 200 feet from a poultry structure in the AR District and a minimum of 100 feet from a poultry structure in all other districts, unless a written waiver of such larger setback is provided by the owner of the poultry or livestock use.
Add the following note:
******In the Agricultural Residential Zone, all structures on existing parcels adjacent to poultry houses and manure sheds shall meet the same setbacks (reverse setbacks) as required for poultry houses and manure sheds.
In all other zones, structures on existing parcels adjacent to poultry houses or manure sheds shall double the side and rear setbacks required for that zone.

Amend Section 4.4 Non-conforming Structures. Add the following as item d:
d. The above provisions do not apply to replacement poultry houses on existing poultry farms or poultry farms that have not been inactive for more than three years. Existing setbacks for replacement will be extended to a new chicken house to allow consistency on the property and to avoid economic hardship for growers wishing to expand their operations. The footprint of the non-conforming chicken house may be increased to meet current grower requirements.
